Terms & Conditions

1. Who may use IAMOTION

You must be at least 13 years old. Where local law requires a higher age to consent to online services — 16 in parts of the European Economic Area — you must meet that age instead. If you use IAMOTION on behalf of an organisation, you confirm you are authorised to accept these terms for it.

You may not use IAMOTION if we have previously terminated your account for a breach of these terms, or if doing so would be prohibited by applicable sanctions or export laws.

2. Your account

3. Your content

You keep ownership of what you post. Posts, comments, photos, videos, write-ups, event listings — they remain yours. Nothing in these terms transfers ownership of your content to us.

You are responsible for what you post, and you confirm that you have the rights needed to post it and to grant the licence in section 4. If your content features other people, make sure you have their permission where it is needed.

4. The licence you grant us

To run a service that displays your content, we need your permission to handle it. You grant LTV LLC a worldwide, non-exclusive, royalty-free, transferable and sub-licensable licence to host, store, cache, reproduce, adapt, publish, translate, distribute and display your content — but only for the purposes of operating, promoting and improving IAMOTION, and only consistently with your audience settings.

This licence exists so we can do ordinary technical things: store your photos, resize them for different screens, show your post to the audience you chose, back it up, and send it over a content delivery network.

The licence ends when you delete the content or close your account, within the period it takes to purge our active systems and routine backups. Two things reasonably survive: copies other users have already shared or saved under the settings you chose, and content we must retain for legal or safety reasons.

We do not claim a right to sell your content to third parties, or to license it out for someone else's advertising.

5. Acceptable use

IAMOTION exists so people can share what they love. That only works if the space stays usable. Do not:

6. Moderation and enforcement

We may review reported content and take action where we consider these terms to have been breached. Depending on severity and history, we may limit a post's reach, remove content, restrict a feature, suspend an account, or terminate it.

We aim to act proportionately, and to tell you what happened and why — except where telling you would compromise an investigation, put someone at risk, or breach a legal obligation. You may appeal a decision by replying to the notice we send, or by writing to support@iamotion.com. In urgent safety cases we may act first and review afterwards.

We are not obliged to monitor content, and the fact that content remains on IAMOTION is not an endorsement of it.

7. Communities you run

If you create or moderate an interest community, you may set additional rules for it, provided they do not conflict with these terms. You are responsible for moderating in good faith and without discriminating against people on the basis of a protected characteristic. We may step in where a community is being used to breach these terms, and may transfer or close a community that has been abandoned or is causing harm.

8. Events and meeting people

IAMOTION helps you find events and connect with people, and much of what it is for happens away from a screen. Please read this section carefully.

To the fullest extent the law allows, LTV LLC is not liable for anything that happens at, on the way to, or as a result of an event found through IAMOTION, or for the conduct of any user, online or offline.

10. Our intellectual property

IAMOTION, the IAMOTION name and wordmark, and the software, design and content we provide are owned by LTV LLC or our licensors, and are protected by intellectual property law. We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use IAMOTION as intended by these terms. That licence does not include the right to use our branding without our written permission.

11. Feedback

If you send us suggestions, we may use them without restriction or obligation to you. Please do not send us anything you consider confidential or want to be paid for.

12. Third-party services

IAMOTION links to and integrates with services we do not control, including app stores, sign-in providers and mapping services. Their own terms govern your use of them, and we are not responsible for their content or conduct. Where you download our app from an app store, that store's terms also apply to the download.

13. Disclaimers

IAMOTION is provided “as is” and “as available”. To the fullest extent permitted by law, LTV LLC disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

We do not warrant that the service will be uninterrupted, secure or error-free, that content will be accurate, or that any event, community or person you find through IAMOTION will meet your expectations. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

14. Limitation of liability

To the fullest extent permitted by law, LTV LLC and its members, officers, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data, goodwill or anticipated savings, arising out of or relating to your use of IAMOTION.

Our total liability for all claims relating to the service, in aggregate, will not exceed the greater of (a) the amount you paid us for the service in the twelve months before the event giving rise to the claim, or (b) 100 US dollars.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited — including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation. If you are a consumer, these terms do not affect your statutory rights.

15. Indemnification

You agree to indemnify and hold harmless LTV LLC and its members, officers, employees and agents from any claim, demand, loss or expense, including reasonable legal fees, arising out of your content, your use of IAMOTION, your breach of these terms, or your violation of any law or third-party right. This does not apply to the extent the claim arises from our own wrongdoing.

16. Termination

You may stop using IAMOTION and close your account at any time. We may suspend or terminate your access if you breach these terms, if we are required to by law, or if continuing to provide the service to you would create a risk to others or to us. Where circumstances allow, we will give reasonable notice.

Sections that by their nature should survive — including 4 as it applies to content already shared, 10, 11, 13, 14, 15, 17 and 19 — continue to apply after termination.

17. Governing law and venue

These terms are governed by the laws of the State of Nevada, United States, excluding its conflict-of-laws rules. You and LTV LLC agree to the exclusive jurisdiction of the state and federal courts located in Washoe County, Nevada for any dispute arising out of or relating to these terms or the service, and each of us waives any objection to venue there.

If you are a consumer resident in the European Economic Area or the United Kingdom, nothing here deprives you of the protection of the mandatory law of your country of residence, or of your right to bring proceedings in your local courts.

Before starting a formal claim, please contact us — most issues can be resolved quickly by email.

18. Changes to these terms

We may update these terms as the service develops. When a change is material, we will give notice in the app or by email at least 30 days before it takes effect, unless a change must take effect sooner for legal or safety reasons. Continuing to use IAMOTION after a change takes effect means you accept the updated terms. If you do not accept them, close your account.
